Attestation CEE
The first step an employer should take before sending an employee to Luxembourg is to obtain a so-called Attestation CEE, i.e. a certificate stating the nature, period and type of activities carried out in the territory of the Republic of Poland.
In accordance with the provisions of the Act of August 24, 2007 on amending certain acts in connection with the membership of the Republic of Poland in the European Union (Journal of Laws No. 176, item 1238), the authority authorized to issue a certificate stating the nature, period and type of activities performed in Poland is the voivodship marshal:
- competent for the place of residence of the person submitting the application,
- Competent by reason of the last place of performance of the business or the last place of employment, in the absence of residence in the Republic of Poland of the person making the application.
The issuance of the certificate referred to above is subject to a fee of PLN 50. The application shall be accompanied by such documents as: photocopies of identity card or passport, photocopies of work certificates, a photocopy of a certificate of entry in the business activity register, a photocopy of professional special rights and others. This document is necessary for further notifications at Luxembourg offices.
